Welcome to Fenzy. These Terms of Service ("Terms") govern your access to and use of the Fenzy application, website, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.
By creating an account, downloading our app, or using our Service in any way, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.
You must be at least 13 years old to use Fenzy. If you are under 18, you must have permission from a parent or guardian to use the Service. By using Fenzy, you represent and warrant that you meet these eligibility requirements.

We offer a 3-day free trial for new users. You will not be charged during the trial period. After the trial ends, your subscription will automatically renew unless you cancel before the trial period expires.
We offer various subscription plans (monthly and yearly). Subscription fees are non-refundable except as required by law or as expressly stated in these Terms.
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will continue to have access until the end of the paid period.

Streaming quality depends on your internet connection and device capabilities. We offer various quality options including HD and 4K where available.
The Fenzy name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Fenzy or its affiliates. You may not use these marks without our prior written permission.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using Fenzy, you consent to our data practices as described in the Privacy Policy.
Fenzy may integrate with or contain links to third-party services, websites, or content. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO FENZY IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Fenzy, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@fenzy.app. We will attempt to resolve the dispute informally within 60 days.

The Fenzy mobile application is licensed, not sold, to you. This license is limited to using the app on devices you own or control.
When you download our app from a third-party app store (Google Play, Apple App Store), you also agree to that app store's terms of service.
The app store providers are third-party beneficiaries of these Terms with respect to the mobile application and have the right to enforce these Terms.
